Terms and Conditions

These terms and conditions ("Agreement") govern the use of the padel court facility ("Facility") provided by Padel on 101, staff or agents ("Provider") to any person booking courts or attending the Facility in relation to that booking either as a player or guest ("Customer"). By booking or using the Facility, the Customer agrees to be bound by the Agreement.

Booking and Payment
 

a. The Customer must make a reservation in advance to book the Facility. Reservations can be made through the Website or direct with the Facility subject to availability.

b. The Customer shall provide accurate and complete information during the booking process, including the desired date, time, and duration of the booking.

c. Payment for the booking shall be made in person, unless otherwise agreed upon by the Provider. All fees and charges are non-refundable, unless otherwise stated in this Agreement.

d. The Provider reserves the right to cancel bookings at their discretion without any prior notice. 
 

Facility Usage:

a. Customers shall adhere to the designated time slot allocated for their booking.

b. Appropriate apparel, including a shirt and non-marking footwear designed for racket sports, shall be worn on court and may also be worn throughout the Facility.

c. Customers may bring their own padel equipment, such as rackets and balls. Provider may offer rental equipment subject to availability and separate charges. Tennis balls are not allowed whatsoever.

d. Customer shall follow all Provider’s safety instructions and guidelines and shall conduct themselves in a respectful and sportsmanlike manner.

e. Provider reserves the right to refuse service, terminate bookings, or deny access to the Facility to any Customer who violates this Agreement, engages in unsafe behaviours, or poses a threat to others' safety or the Facility.
f. Alcohol and pork products are strictly prohibited on the entire premises.
 

Cancellations and Refunds:

a. Customers bookings are non-refundable, and payments will be due irrespective of Customer’s completing the booking.

b. Provider may at its sole discretion cancel the booking due to health and safety concerns or any other unforeseen circumstance and will make reasonable efforts to reschedule the booking or provide a refund.
c. Customers may contact our support team at least 12 hours prior to the booking time-slot to cancel or reschedule.
 

Liability and Indemnity:

a. Customers acknowledge and agree that they use the Facility is at their own risk. That taking part in the activity may through no fault of the Provider result in injury, permanent incapacity or death. Provider shall not be liable for any injuries, damages, or losses incurred by the Customers while using the Facility and that the total damages for injury, property damage and loss is limited to the price paid for the booking.

b. The Customer further agrees to indemnify and hold the Provider harmless from any claims, damages, liabilities, costs, or expenses arising from the Customer use of the Facility or any violation of this Agreement.

c. Padel is an energetic game and if at any time The Customer feels unwell in any sense they must cease play and seek proper medical assistance. Furthermore play involves fast moving bodies and projectiles and customer accepts the risks and warrants they are healthy and will wear appropriate sports clothing and protective gear such as protective padding and eye wear to minimise the possibility of injury and accepts that failure to do so will be entirely at their risk and that they indemnify the Provider against all claims, damages, liabilities, costs, or expenses arising from the Customer's participation and use of the facility.

 

Racket Rentals

1. Responsibility for Equipment: The client agrees to take full responsibility for the padel rack-et(s) hired from Padel on 101. This includes any loss, damage, or theft that may occur during the hire period.

2. Proper Use: The client agrees to use the padel racket(s) only for their intended purpose and in accordance with all safety guidelines provided by Padel on 101.

3. Return Condition: The client agrees to return the padel racket(s) in the same condition as they were received, normal wear and tear excepted. Any damage beyond normal wear and tear will be the responsibility of the client.

4. Damage Compensation: In the event that the padel racket(s) are damaged during the hire period, the client agrees to compensate Padel on 101 with a fee of $60 per damaged racket.

5. Late Returns: The client agrees to return the padel racket(s) by the agreed-upon return time. Late returns may result in additional charges as outlined by Padel on 101.

6. Safety: The client acknowledges that the use of padel racket(s) carries inherent risks, including but not limited to injury. The client agrees to use the equipment safely and responsibly, and Padel on 101 shall not be held liable for any injuries or damages that occur during the hire period.

7. Payment: The client agrees to pay the agreed-upon hire fee for the padel racket(s). Payment is due at the time of hire. VIII.

8. Reservation: Padel on 101 reserves the right to refuse or cancel any reservation at its discretion.
    

Entire Agreement, Governing Law and Jurisdiction:

a. By making a booking and using the Facility, the Customer acknowledges that they have read, understood, and agreed to be bound by the Agreement.

b. If any provision of this Agreement is deemed invalid or unenforceable, all other provisions shall continue in full force and effect.

c. This Agreement shall be governed by the Laws of Zimbabwe.
